1. About these terms
These terms and conditions ("Terms") govern your use of the Pangea VPN service ("Service") provided by Pangea VPN ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
Please read these Terms carefully before subscribing. If you do not agree with any part of these Terms, you should not use the Service.
Pangea VPN is an independent service operated from the United Kingdom. You can contact the operator at [email protected], and the operator contracts with you directly for the provision of the Service.
These Terms are governed by the laws of England and Wales, but this does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you reside. Wherever you live, nothing in these Terms excludes, restricts or modifies any statutory or consumer-protection right, guarantee or remedy that applies to you and that cannot lawfully be excluded or limited by contract — including, where applicable, your rights under the UK Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, European Union and EEA consumer law, the Australian Consumer Law, and comparable consumer-protection legislation elsewhere. Where any provision of these Terms conflicts with such a mandatory right, that right prevails to the extent of the conflict.
2. The Service
Pangea VPN provides a virtual private network service that encrypts your internet connection and routes it through our servers. The Service includes access to VPN configuration files, client setup guidance, and account management through our web dashboard.
We will make reasonable efforts to keep the Service available and performant, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be communicated in advance where practicable.
We reserve the right to manage network capacity in order to maintain the quality and availability of the Service for all users. This may include imposing reasonable limits on bandwidth, throughput, or data transfer rates, whether generally or during periods of high demand. We may also prioritise certain types of traffic or apply fair usage policies where we reasonably determine that a user's consumption is disproportionately affecting the experience of other users. Where practicable, we will provide advance notice of any material changes to bandwidth or speed allocations.
3. Eligibility
You must be at least 18 years old to use the Service. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate and complete.
4. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately at [email protected] if you suspect unauthorised access.
5. Subscription and pricing
The Service is provided on a monthly subscription basis. The current price is £5.49 per month, inclusive of VAT where applicable. We may offer a 3-day free trial to new subscribers who have not previously held a subscription.
All prices are displayed in pounds sterling (GBP). Payments are processed securely by Stripe. Your subscription will automatically renew each month unless cancelled.
We may change our prices by giving you at least 30 days' written notice. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.
6. Right to cancel (cooling-off period)
If you are a consumer in the United Kingdom, the European Union or the EEA, you have the right to cancel your subscription within 14 days of the date the contract is entered into (the date your subscription starts), without giving any reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the EU Consumer Rights Directive. If you are a consumer elsewhere, you benefit from any equivalent or more generous mandatory cancellation, withdrawal or “cooling-off” right available under the law of the country in which you reside.
To exercise your right to cancel, notify us by email at [email protected] with a clear statement of your decision. You may also cancel through the Stripe customer portal accessible from your billing page.
By activating a free trial or connecting to the VPN during the cancellation period, you expressly request that the Service begin immediately and before the end of that period, and you acknowledge that you will be required to pay, on a pro-rata basis, for the Service actually supplied up to the moment you cancel. This does not affect any mandatory cancellation right that applies to you and that cannot be waived under your local law.
We will process any refund due within 14 days of receiving your cancellation notice, using the same payment method you used for the original transaction.
7. Cancellation after the cooling-off period
You may cancel your subscription at any time after the 14-day cooling-off period through your billing page or by emailing [email protected]. When you cancel:
- Your subscription remains active until the end of the current billing period.
- VPN access is automatically revoked at the end of that period.
- No further charges will be made after cancellation.
- Refunds are not provided for partial billing periods after the cooling-off period, except where required by law.
Nothing in this section affects your right to a refund, replacement or other remedy where the Service is faulty, not as described, or otherwise fails to meet a guarantee that cannot be excluded under the consumer law that applies to you (for example, the consumer guarantees under the Australian Consumer Law or the conformity rights under UK and EU consumer law). Those remedies are provided as that law requires, regardless of any “no refund” statement above.
8. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation, including but not limited to the Computer Misuse Act 1990, the Fraud Act 2006, and the Terrorism Act 2000.
- Infringe the intellectual property rights of any third party.
- Distribute malware, conduct network attacks, or attempt to gain unauthorised access to systems.
- Send unsolicited bulk communications (spam).
- Distribute, store, or access child sexual abuse material or any content that is illegal under UK law.
- Engage in any activity that materially degrades the Service for other users.
We reserve the right to suspend or terminate your account immediately if we reasonably believe you have breached this acceptable use policy. Where practicable, we will provide notice and an opportunity to remedy the breach before termination.
9. Our liability to you
We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any matter for which it would be illegal to exclude or limit liability.
Subject to the above, if we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is an obvious consequence of our breach, or if it was contemplated by you and us at the time the contract was entered into.
We are not liable for any loss or damage that is not foreseeable, including indirect or consequential losses. We are not liable for business losses (the Service is provided for private, domestic, and personal use only).
Our total liability to you for all claims arising under or in connection with these Terms shall not exceed the total subscription fees you have paid to us in the 12 months preceding the claim.
Except as expressly set out in these Terms, and to the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. We make no representations or warranties, express or implied, regarding the Service, including any implied warranties of satisfactory quality, fitness for a particular purpose, or non-infringement, save for any warranties, guarantees or remedies that cannot be excluded under the consumer law that applies to you (including, where applicable, the UK Consumer Rights Act 2015 and the Australian Consumer Law).
10. Service changes and updates
We may update the Service from time to time, including changes to infrastructure, protocols, server locations, and features, to maintain reliability, security, and performance. We will give you reasonable notice of any changes that materially reduce the functionality of the Service.
If a change materially and adversely affects your use of the Service, you may cancel your subscription and receive a pro-rata refund for the remainder of your billing period.
11. Intellectual property
All intellectual property rights in the Service, website, and related materials belong to us or our licensors. Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal purposes during the subscription period.
12. Changes to these Terms
We may revise these Terms from time to time. Material changes will be notified to you via email or a prominent notice on our website at least 30 days before they take effect. Your continued use of the Service after the revised Terms take effect constitutes acceptance of the changes. If you do not agree, you may cancel your subscription before the changes take effect.
13. Suspension and termination
We may suspend or terminate your access to the Service if:
- You breach these Terms and fail to remedy the breach within a reasonable period after we notify you.
- You commit a serious or repeated breach of these Terms.
- Your subscription payment fails and is not resolved within 7 days.
- We are required to do so by law or a regulatory authority.
If we terminate your account without cause, we will refund any prepaid subscription fees on a pro-rata basis.
14. Dispute resolution
If you have a complaint, please contact us at [email protected] and we will do our best to resolve the issue. If we cannot resolve your complaint to your satisfaction, you may refer it to an alternative dispute resolution (ADR) provider. You also retain the right to bring a claim in the courts of England and Wales (or, if you live in Scotland, the Scottish courts, or if you live in Northern Ireland, the Northern Irish courts).
15. Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection provisions of the law of the country or region in which you reside, and you may bring proceedings in your local courts where the mandatory law applicable to you gives you that right. Consumers resident in Scotland or Northern Ireland may also bring proceedings in their local courts.
16. Privacy
Our Privacy Policy explains how we collect, use, and protect your personal data. It forms part of these Terms.
17. Your responsibility and indemnity
You are solely responsible for all activity conducted through your account and over your VPN connection, including all content transmitted, received, or stored by you. The Service routes your traffic but does not monitor, control, endorse, or take editorial responsibility for what you do with it.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold us harmless from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your breach of these Terms or the acceptable use policy in section 8; (c) your violation of any law or regulation; or (d) your infringement of any third party's rights, including intellectual property rights.
Nothing in this section limits your statutory rights as a consumer or applies to liability that cannot lawfully be excluded.
18. Lawful disclosure and law enforcement
We will cooperate with valid legal process issued by competent authorities, including court orders, production orders, and notices issued under the Investigatory Powers Act 2016, the Police and Criminal Evidence Act 1984, or equivalent legislation. Where we are required by law to retain or disclose data, we will do so to the extent legally compelled.
We do not log VPN traffic content, browsing activity, or DNS queries, and so we cannot disclose what we do not hold. We do hold limited operational data such as account, billing, and provisioning records as described in our Privacy Policy, and we may be compelled to disclose this data. Where we are not legally prohibited from doing so, we will inform affected users.
